General Terms and Conditions (GTC)

1. Scope of Application

1.1 These General Terms and Conditions (GTC) apply to all business relationships between Jermina Isa™ and its customers, concluded in-store, online, or through any other means.

1.2 Any differing, conflicting, or supplementary terms and conditions of the customer will only become part of the contract if they have been expressly acknowledged in writing by the Fashion Business.

2. Conclusion of Contract

2.1 The presentation of goods in the store or on online platforms does not constitute a legally binding offer, but rather a non-binding invitation to purchase products.

2.2 The contract is formed when the Fashion Business confirms the customer’s order in writing, by email, or by handing over the goods.

3. Prices and Payment Terms

3.1 All prices are quoted in Swiss francs (CHF) and include the statutory value-added tax (VAT).

3.2 Payments are to be made in cash, by card, or through other accepted payment methods, as agreed. For custom orders, orders placed with suppliers, and regular purchases of items available in the store, a deposit of at least 50% of the purchase price is required.

3.3 The remaining balance must be paid in full upon collection or prior to delivery of the goods.

4. Custom-Made Items and Alterations

4.1 Custom-made items are produced according to the customer’s specific requirements. The customer agrees to be available for necessary fittings in a timely manner..

4.2 Requests for changes after the design has been confirmed or production has begun can only be considered if they are technically and timely feasible. Any additional costs incurred will be charged accordingly.

4.3 The Fashion Business is not liable for fitting issues caused by inaccurate information or changes in the customer’s body measurements after the final fitting.

5. Delivery and Collection

5.1 Stated delivery times are non-binding unless expressly agreed in writing to be binding.

5.2 Finished products must be collected within 14 days.

5.3 The risk of loss or damage passes to the customer or a person designated by the customer upon handover of the goods.

5.4  If the ordered dress cannot be delivered on time (no later than one day before the wedding) or at all due to circumstances beyond Jermina Isa's™ control—such as supplier or manufacturer issues—the purchase contract becomes void. Jermina Isa™ assumes no liability or warranty beyond statutory obligations in such cases.

5.5 In the event of delays caused by the customer, no claims for damages against Jermina Isa can be made due to the delay.

6. Returns and Exchanges

6.1 Custom-made items, personalized products, as well as worn or damaged goods, are excluded from returns and exchanges.

6.2  After the verbal or written conclusion of the contract, goods are excluded from return or exchange.

6.3   Complaints will only be accepted if reported immediately (before the goods leave the store). Complaints about goods already taken are not accepted.

7. Liability

7.1 The Fashion Business is liable for intentional and grossly negligent breaches of duty.

7.2  In cases of simple negligence, the Fashion Business is liable only for damages resulting from the breach of essential contractual obligations (cardinal obligations) and only up to the foreseeable, typical contractual amount of damage.

7.3 Claims for indirect damages, consequential damages, or lost profits are excluded to the extent permitted by law.

7.4 The Fashion Business is not liable for damages resulting from improper handling, care, or alteration of the goods by the customer.

7.5 Liability for damages to life, body, and health, as well as under the Swiss Product Liability Act, remains unaffected.

8. Retention of Title

8.1 The goods remain the property of the Fashion Business until payment is made in full.

8. Data Protection

9.1 The Fashion Business collects and processes the customer’s personal data solely for the purpose of fulfilling the contract.

9.2 Further details on the processing of personal data are regulated in the Fashion Business's privacy policy

10. Force Majeure

10.1 The Fashion Business is not liable for delays or non-performance caused by events of force majeure (e.g., natural disasters, strikes, pandemics).

9. Final Provisions

11.1  Swiss law shall exclusively apply.

Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.

11.3 Any amendments or supplements to these GTC must be made in writing.
